DeFUNIAK SPRINGS - In addition to a lawsuit for allegedly causing a fatal car accident in July, former Walton County Commissioner Herman Walker now is charged with operating his tractor-trailer in violation of several state regulations.
According to the final Florida Highway Patrol accident report, Walker, 61, has been charged with driving left of the center line, driving the tractor-trailer with two brakes out of adjustment, failing to obtain a periodic inspection for the rig and exceeding the maximum weight by more than 1,000 lbs.
Walker is scheduled to appear in court Sept. 24 to face those charges.
The tractor-trailer was last inspected May 31, 2007, more than a year before the accident that killed 38-year-old Eric Buharp, injured his wife and two young sons, and left 9-year-old Katie Johnson in critical condition.
Walker and his passenger, David Alford, were traveling south on State Road 2A north of DeFuniak Springs at about 6:05 p.m. July 11 when Walker allegedly lost control on a curve, according to the FHP. The rig overturned and slammed into the driver's side of the Buharps' sport utility vehicle
